Chatham pair indicted on charges, involving rape of a child

JUAN DIEGO CRUZ

THE GRAND JURY OF THE COUNTY OF COLUMBIA, by this indictment, accuses the defendant, JUAN DIEGO CRUZ, with the commission of the crime of RAPE IN THE FIRST DEGREE, a Class B Felony, in violation of §130.35, subdivision 1, of the Penal Law of the State of New York, in that the defendant, on or between July and August, 2019, in the County of Columbia, State of New York, did engage in sexual intercourse with another person by forcible compulsion, to wit: on the aforesaid date and at the aforesaid place, the defendant engaged in sexual intercourse with another person by forcible compulsion.

COUNT TWO

THE GRAND JURY AFORESAID, by this indictment, further accuses the defendant, JUAN DIEGO CRUZ, with the commission of the crime of RAPE IN THE SECOND DEGREE, a Class D Felony, in violation of §130.35, of the Penal Law of the State of New York, in that the defendant, on or about between the end of July and beginning of August, 2019, in the County of Columbia, State of New York, did, being eighteen years old or more, engage in sexual intercourse with another person less than fifteen years old, to wit: on the aforesaid date and at the aforesaid place, the defendant, being eighteen years old or more, engaged in sexual intercourse with another person less than fifteen years old.

COUNT THREE

THE GRAND JURY AFORESAID, by this indictment, further accuses the defendant,

JUAN DIEGO CRUZ, with the commission of the crime of ENDANGERING THE WELFARE OF A CHILD, a Class A Misdemeanor, in violation of §260.10, subdivision 1, of the Penal Law of the State of New York, in that the defendant, on or between July and August, 2019, in the County of Columbia, State of New York, did knowingly act in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old or directs or authorizes such child to engage in an occupation involving a substantial risk of danger to his or her life or health, to wit: on the aforesaid date and at the aforesaid place, the defendant knowingly act in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.

ITZEL RIVERA

THE GRAND JURY OF THE COUNTY OF COLUMBIA, by this indictment, accuses the defendant, ITZEL RIVERA, with the commission of the crime of ASSAULT IN THE THIRD DEGREE, a Class A Misdemeanor, in violation of §120.00, subdivision 1, of the Penal Law of the State of New York, in that the defendant, on or about September 26, 2019, in the County of Columbia, State of New York, did, with intent to cause physical injury to another person, cause such injury to such person or to a third person, to wit: on the aforesaid date and at the aforesaid place, the defendant, with intent to cause physical injury to another person, cause such injury to such person.

COUNT TWO

THE GRAND JURY AFORESAID, by this indictment, further accuses the defendant, ITZEL RIVERA, with the commission of the crime of ENDANGERING THE WELFARE OF A CHILD, a Class A Misdemeanor, in violation of §260.10, subdivision 1, of the Penal Law of the State of New York, in that the defendant, on or about June 2019, in the County of Columbia, State of New York, did knowingly act in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old or directs or authorizes such child to engage in an occupation involving a substantial risk of danger to his or her life or health, to wit: on the aforesaid date and at the aforesaid place, the defendant knowingly act in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.

COUNT THREE

THE GRAND JURY AFORESAID, by this indictment, further accuses the defendant, ITZEL RIVERA, with the commission of the crime of ENDANGERING THE WELFARE OF A CHILD, a Class A Misdemeanor, in violation of §260.10, subdivision 1, of the Penal Law of the State of New York, in that the defendant, on or about September 26 2019, in the County of Columbia, State of New York, did knowingly act in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old or directs or authorizes such child to engage in an occupation involving a substantial risk of danger to his or her life or health, to wit: on the aforesaid date and at the aforesaid place, the defendant knowingly act in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.
